An anti-liberal and anti-democratic legislative proposal of the Law about transgressions against public order and peace

osobne slobode1Zagreb, 18th of February – "The new definition of public space in the legislative proposal of the Law about transgressions against public order and peace means that the private also becomes public, which is a rigid lunge into human privacy. This legislative proposal is, by its content anti-liberal and anti-democratic and rigourously sanctions insults, the expression of personal opinion and public criticism of officials and state institutions. This serves to narrow the space for political competition, and the regular practice of criticism turns into a transgression", highlighted CPP's parliamentary representative Goran Beus Richembergh on CPP's Political Academy's and CPP's Youth Division's round table discussion on the subject of "Boundaries of personal freedoms – legislative proposal of the Law about transgressions against public order and peace".

The lecturers on the round table discussion were Sandra BenĨić and Gordan Bosanac from the Centre for peace studies, Davor Gjenero, political analyst and Zvonimir KlobuĨar, president of CPP's Youth Division's Interest committee.

"We cannot call this a legislative proposal. According to the liberal democrats it must be rationally founded and withstand a rational critique, but when you read this you do not share liberal values. There isn't any contribution to the public good here, this legislative proposal goes under every level of all we have been reaching for this whole time. The legislative proposal, in this form, doesn't suffer a rational critique and jeopardizes human rights", highlighted Davor Gjenero, political analyst.

"This legislative proposal is non-proportional to its goal. It is full of unspecified legal terms which are determined on a case-to-case basis. The law must be a basis of democratic society and the goal is that personal and citizen liberties aren't infringed upon by certain behaviours", said Sandra BenĨić and Gordan Bosanac for the Centre for peace studies.

"The existing regulations are insufficiently defined, and the prescripted fines aren't uniform. A lot of things hang in the air, citizens liberties are limited and CPP's Youth Division had to react which resulted in a round table discussion being held on this subject", said Zvonimir KlobuĨar, president of CPP's Youth Division.

        "This is a law about morals. It is important for the law to be passed, but with a larger spectrum of human liberties. The public must be warned in order for as large a number of people as possible to get introduced with the legislative proposal and what it brings in this moment", said Boris Blažeković, Academy director and CPP's parliamentary representative.

"Everything we've discussed today isn't just a question of personal liberties, is is also a question of public life and space. We are a secular state oriented towards liberal-democratic subjects, and they should be and are the guidelines for legislation", concluded Sandra BenĨić from the Centre for peace studies.
