"The local elections were won on legalisation"

legalizacija webZagreb, 1st of March 2014 – "The point of legalisation is based on criteria, and what is legalised is the fact that a building exists in space. Believe me that local elections were won on legalisation", said Anka Mrak Taritaš, Minister of construction and spatial planning, at the beginning of her lecture about spatial planning and reflections of legalisation in units of local self-governance.

 

 

 

The Minister highlighted the important phases of legalisation which have been sorted in the Law about spatial planning and construction in such a way that thirty percent of the funds go into the budget of the unit of local self-governance in whose space the illegaly built building is located, twenty percent for the work of the Office (space, computers, wages for people), and fifty percent goes into the state budget. What she highlighted with this calculation is that eighty percent must be returned into the space.

In the continuation she spoke about two basic steps of application of tha Law. The first step is the creation and bringing about the amendments of spatial plans of cities and municipalities which would determine new or enlarge existing construction areas, but only for those spatial coverages which comply with spatial planning conditions. The second step is the eventual creation of execution documents of spatial planning which would plan conditions and criteria of urban renovation. Namely, as the Minister said, in this way the ways and forms of use of public and other spaces would be determined, as well as the evaluation of areas of special limits in the way of use.

She put importance on the thesis that5 by 2015 all applications for legalisation must be solved and use legalisation for your own promotions. The point of legalisation doesn't lie in rejecting applications, however, if a complete application isn't given, there is no basis on which it can be done.

The second part of the seminar related to the novelties in the area of spatial planning, construction and construction inspection where Mrak Taritaš put emphasis on the state, county, city and municipality spatial plan. The goal of a state spatial plan is to plan that which is of interest and importance to the state and that everything can be carried out to the end. Municipalities and cities have to, through their spatial plans, sovereignly use their construction areas and, as she said, all spatial plans which are in effect function in the way that they are.

An important novelty is also the setting up of and information system of spatial planning (ISSP). As the Minister said, with it a new way of treatingspace forms, and everything can be seen fron the cadastre, land registry to the spatial plan. The information system of spatial planning is a tool to be introduced to everything and, as Taritaš said, work is being done on the reception of and e-permit, and everything that is legalised will be able to be seen on it.

"The information system of spatial planning is our truth about space. It is a tool and a base for everything, and, what's most important, it is open and available to all citizens, concluded the Minister.

The seminar was held as part of the 1st Department of the Academy for additional education of CPP's elected representatives, and it was opened by Boris Blažeković, Academy director and CPP parliamentary representative.
